Residence permit in Slovakia

  In this short article we will talk about a residence permit in Slovakia (hereinafter referred to as residence permit), what are the types of residence permit in Slovakia, who and how can obtain this residence permit.   So, a residence permit in Slovakia is divided into temporary and permanent. To avoid confusion, we will call the temporary residence permit – residence permit, and the permanent residence permit – permanent residence. So what is the difference between them?

  Temporary residence permit (residence permit) provides the right to reside in Slovakia to a foreign citizen of a third country who is going to work, engage in entrepreneurial activity, and study in the territory of the Slovak Republic. A residence permit can be granted, after fulfillment of all conditions specified in the law and on the basis of the submitted application.

 

Residence permit is granted for the purpose of:

  1. Entrepreneurship
  2. Employment or seasonal employment
  3. Study
  4. Certain types of activities (lecture, sports, cultural, volunteering, the activities of an accredited journalist, the provision of medical care, internships, etc.)
  5. Research activities
  6. Family reunification
  7. Performing official duties by the peacekeeping units of the armed forces
  8. A person with a recognized position as a Slovak living abroad
  9. A person with a recognized long-term residence permit in another EU member state.

 

Most often, a residence permit is issued for employment, business and family reunion.

 

How to get a residence permit (residence permit) in Slovakia (procedure)

An application for the issue of a temporary residence permit must be submitted personally, with the exception of cases of family reunification, when an alien with whom the reunification is applying for an incompetent applicant.

 

There are two options for applying for a residence permit:

  1. The application is filed abroad at the diplomatic mission of Slovakia, accredited in the state that issued the foreign passport to the applicant or in which the applicant has a place of residence. The diplomatic mission of the Slovak Republic, which accepted the application, will conduct a personal interview for a preliminary assessment of the application.
  2. An application for a temporary residence permit can also be submitted to the relevant immigration police department at the place of residence in the territory of the Slovak Republic.

 

Attention! Cannot apply for residence permit

  1. holder of a permit for permissible residence, as his departure from the country is impossible and the detention is impractical and
  2. asylum applicant.

 

Prior to the expiration date, a temporary residence permit issued to a third country national gives the right to legally reside in Slovakia, travel abroad and return to Slovakia.

  The first temporary residence permit can be issued for a different period, depending on the purpose of the stay. If a third country national submits an application for a temporary residence permit with the aim of:

  1. work, special activity or research activity, a residence permit is issued for a period of up to two years;
  2. Entrepreneurship – for a period of up to three years;
  3. family reunification or a person with a long-term residence permit in another state of the European Union (EU) – for up to five years;
  4. for the purpose of study – for a period of up to six years.

  A residence permit is issued only for a specific purpose, which must be confirmed at the time of application. If the purpose of the stay remains the same and the foreigner continues to fulfill all the conditions for living, the state bodies of Slovakia can extend the temporary residence permit, depending on the purpose of the stay, for up to three to five years. But if the purpose changes in connection with which a temporary residence permit was granted, a third country citizen must submit an application for a new permit.

 

Long-term residence permit (permanent residence) is granted for an indefinite period and is granted to a foreigner if:

  1. he is in the territory of Slovakia on an authorized basis for 5 years immediately before applying;
  2. his long-term residence permit was canceled in connection with obtaining a long-term residence permit in another EU member state;
  3. he has a 5-year continuous residence permit in the territory of the countries (s) of the EU member (s) and is in the territory of Slovakia as a holder of the Blue Card for at least 2 years immediately before applying.

 

Permanent residence cannot be issued:

  1. an alien who has applied for refugee status or asylum;
  2. persons with a residence permit for study;
  3. having a residence permit for the purpose of seasonal work;
  4. persons holding a residence permit for the purpose of special activities;
  5. foreigners with diplomatic immunity.

 

  If a foreigner has a temporary residence permit for the purpose of training or special activity, he must first obtain a temporary residence permit for another purpose, for example, work or business, and only then can you apply for a long-term permanent residence permit.
